Terms and Conditions:

  1. Information about the Prize and how to enter forms part of these Terms and Conditions. Participation in this Promotion and acceptance of or participation in any part of the Prize is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Jamaica Blue Pty Limited ABN 13 059 236 387 of Unit 215F1, Building 215, Level 1, The Entertainment Quarter, 122 Lang Road, Moore Park, NSW 2021 | PO Box 303 Double Bay NSW 1360. Website: jamaicabluenz.muffinbreakdev.wpengine.com (Promotion Website).
  3. The Promotion commences at 12:00am AEST on Tuesday 4th May,2021 and closes at 11:59pm AEST on Mon 31st May 2021 (Promotion Period). No entries outside of the Promotion Period will be accepted. The time of entry is the time that an entry is received by the Promoter.
  4. Entry is open to all Australian citizens and permanent residents (Australian Residents) aged 18 years and over at the commencement of the Promotion Period who remain Australian Residents for the duration of the Promotion Period, except for the following persons who are not eligible to enter:
    1. directors, officers and employees (and their Immediate Family Members) of the Promoter, of the Promoter’s related entities, of the Promoter’s distributors or suppliers, or of agencies associated with the Promotion;
    2. persons assisting with the Promotion (and their Immediate Family Members);
    3. the Promoter’s franchisees (and their Immediate Family Members); and
    4. directors, officers, employees (and their Immediate Family Members) of the Promoter’s franchisees.
  5. To enter the Promotion, entrants must:
    1. during the Promotion Period:
      1. purchase one (1) or more Eligible Product in a single transaction from a Participating Café; and
      2. either:
        1. have their Jamaica Blue loyalty card scanned by that Participating Café at the time of such transaction; or
        2. have their rewards barcode or QR code in the Jamaica Blue App scanned by that Participating Café at the time of such transaction
      (collectively, Eligible Purchase); and
    2. before the end of the Promotion Period:
      1. have registered as a Jamaica Blue loyalty member; and
      2. either:
        1. at the time of registering as a Jamaica Blue loyalty member, or when signing up to the Jamaica Blue App, have subscribed to receive exclusive offers, rewards and freebies; or
        2. if a holder of a Jamaica Blue loyalty card, have logged in to their Jamaica Blue loyalty member account and subscribed to receive exclusive offers, rewards and freebies ; or
        3. if a user of the Jamaica Blue App, have logged in to the Jamaica Blue App and subscribed to receive promotional material by ticking the “Marketing Opt In” check box in the section of the Jamaica Blue App Menu titled “My Details”.
      (collectively, Registered and Subscribed); and
    3. remain Registered and Subscribed at the end of the Promotion Period and at the time the prize draw and any re-draw takes place.Each Eligible Product in a single transaction represents 1 entry. (Eg. if you purchase 3 Eligible Products in 1 transaction = 3 entries), except for Eligible Purchases made between 12:00am AEST and 11:59pm AEST on Tuesday 18th May 2021 during which time each Eligible Product in a single transaction represents 2 entries (Eg. If you purchase 3 Eligible Products in 1 transaction = 6 entries).Redemption of free coffees, including redemption through the Jamaica Blue loyalty program and redemption through any other offer from the Promoter, cannot form part of an Eligible Purchase even where the free coffee being redeemed is upgraded, added to or otherwise modified.Holders of Jamaica Blue loyalty cards may register as a Jamaica Blue loyalty member and login to their Jamaica Blue loyalty member account at the Promotion Website. Users of the Jamaica Blue App are automatically registered as a Jamaica Blue loyalty member when they sign up to the Jamaica Blue App.
  6. The Promoter and Participating Cafes accept no responsibility for any Eligible Product being unavailable at a Participating Café.
  7. Multiple entries are permitted.
  8. The Promotion is a game of chance and winners of the Prize will be determined by random draws of all valid entries. All valid entries received by the Promoter during the Promotion Period will be divided into separate entry pools based on the Participating Café where an Eligible Purchase was made. The Promoter will conduct a separate draw in respect of each separate entry pool. The first valid entry drawn in respect of each separate entry pool will win the Prize. Only one (1) Prize will be awarded in respect of each separate entry pool.
  9. The random draws to determine the winners of the Prize will take place, in the presence of an independent scrutineer, at 12 pm AEST on Friday, 11th June, 2021 at Level 2, 11 York St, Sydney NSW 2000.
  10. The Promoter may draw additional reserve entries in respect of each separate entry pool and record them in order. In the event that an invalid entry or ineligible entrant is drawn then the Prize will be awarded to the first reserve entry drawn in respect to that separate entry pool. The Promoter will continue this process until the Prize is awarded in respect to each separate entry pool.
  11. Entrants are only eligible to win the Prize once (except for SA residents) irrespective of the number of entries they submit. In the event that an entrant is drawn as a winner of a separate entry pool such entrant will be deemed an ineligible entrant in respect to any further separate entry pool draws.
  12. The Prize is “free coffee for life” in the form of a daily credit to a winner’s Jamaica Blue registered loyalty account for twenty (20) years of one (1) free small size Jamaica Blue Coffee redeemable at any Jamaica Blue Café Store in Australia that is open for trade on the date of redemption. The value of the Prize is up to $29,930.00 (including GST).
  13. The Promoter will provide each winner with a gold card. Unless the Promoter determines otherwise, winners must redeem the Prize by presenting to a Jamaica Blue Café Store for scanning the actual gold card provided by the Promoter (copies of the actual gold card, including copies in electronic and/or digital form, will not be accepted by Jamaica Blue Café Stores). If not used by a winner the daily credit to the winner’s Jamaica Blue registered loyalty account expires at the end of each day. Redemption of the Prize is subject to availability at any Jamaica Blue Café Store. Winners acknowledge that not all Jamaica Blue Coffees may be available at a Jamaica Blue Café Store at the time of redemption. The Promoter and Jamaica Blue Café Stores accept no responsibility for a Jamaica Blue Coffee being unavailable at a Jamaica Blue Café Store. Jamaica Blue Café Stores reserve the right to substitute ingredients in the Jamaica Blue Coffees.
  14. Unless expressly stated in these Terms and Conditions all costs and expenses associated with redeeming the Prize or any part of it (including any product variations or add-ons) are a winner’s responsibility. The Promoter and Jamaica Blue Café Stores do not have to vary or substitute the Prize if requested to do so by a winner. Winners are responsible to ensure that the Jamaica Blue Coffees redeemed as part of the Prize are consistent with their dietary requirements. The brand of milk used in a Jamaica Blue Coffee (where applicable) redeemed as part of the Prize is at the sole discretion of the Jamaica Blue Café Store supplying the Prize and may vary during the period in which the Prize can be redeemed.
  15. The Prize is subject to these Terms and Conditions. Winners must comply with all conditions of use of the Prize and Prize supplier’s requirements. Any failure by a winner to comply with the conditions imposed by the Prize supplier may result in the Prize or any part of it being cancelled or withdrawn without liability to the Promoter or the Prize supplier. The Promoter will not be liable if a winner is unable to use the Prize of if a winner loses the Prize.
  16. The Prize or any part of it cannot be transferred to another person or be redeemed by a person other than a winner of the Prize. The Prize or any part of it cannot be exchanged for other goods and/or services or redeemed for cash. If the Prize or any part of it is unavailable for any reason the Promoter in its discretion reserves the right to substitute the Prize or any part of it with goods and/or services of equal value. Unless the Promoter determines otherwise, the Prize cannot be used or redeemed in conjunction with any other offer.
  17. NSW prize pool (34 stores): $1,017,620, QLD prize pool (21 stores): $628,530, SA prize pool (SA participating stores: Jamaica Blue Calvary Adelaide Hospital, Jamaica Blue Colonnades, Jamaica Blue Myer Centre): $89,790, VIC prize pool (16 stores): $478,880, WA prize pool (30 stores): $897,900. The total maximum value of all Prizes awarded in the Promotion is up to $3,112,720 for 104 stores (including GST). This valuation is based on one (1) Prize being awarded in respect of each Participating Café in existence at the commencement of the Promotion Period. If any further Participating Cafes come into existence during the Promotion Period the total maximum value of all Prizes awarded in the Promotion will increase by up to $29,930.00 (including GST) for each Participating Café that comes into existence. All Prize values are reflective of the average recommended retail price of a small size Jamaica Blue Coffee as at 14th January, 2021. The Promoter takes no responsibility for variations in the value of the Prize.
  18. Each winner will be notified via the email address provided on the winner’s registered Jamaica Blue member loyalty account (Registered Email Address) by 5:00pm AEST on 11TH June 2021. Each winner’s name and State/Territory of residence will be published on jamaicabluenz.muffinbreakdev.wpengine.com on 11th June 2021. Winners must claim the Prize by 10th September, 2021.
  19. In the event that all winners have not claimed the Prize by 10th September 2021, the Promoter will, subject to any directions from a regulatory authority, conduct an unclaimed prize draw, in the presence of an independent scrutineer, if required, at 12noon AEST on 11th September, 2021 at Level 2, 11 York St, Sydney NSW 2000 in order to award any unclaimed Prize(s). Winners of the separate pool entry draws are ineligible to win an unclaimed Prize. A redraw will be conducted in respect to each entry pool for which the prize is not claimed by the 10th September, 2021 date.
  20. Each winner of the unclaimed prize draw will be notified via their Registered Email Address by 5:00pm AEST on 11TH September, 2021. Each winner’s name and State/Territory of residence will be published on jamaicabluenz.muffinbreakdev.wpengine.com by 11th September, 2021. Winners must claim the Prize by 11th December 2021
  21. All of the Promoter’s decisions in connection with all aspects of the Promotion are final and no correspondence will be entered into.
  22. Entrants can only enter in their own name. Entrants who provide misleading or fraudulent information are ineligible to participate in the Promotion and all entries of an entrant who is deemed by the Promoter to have provided misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. A purchase of an Eligible Product from a website, such as from the jamaicabluenz.muffinbreakdev.wpengine.com website or the www.jblue.myshopify.com website, cannot form part of an Eligible Purchase.
  23. Incomplete, illegible or incorrect entries, or those that in the Promoter’s sole discretion contain offensive, inappropriate, or defamatory material, or which breach any law or infringe any third party rights, will be deemed invalid. All entries received become the property of the Promoter.
  24. Other than in accordance with these Terms and Conditions, entrants are not permitted to use any automated entry software or any mechanical, electronic or other means that allows them to automatically enter or enter repeatedly.
  25. The Promoter reserves the right at any time in its sole discretion to verify the validity of entries, entrants and winners (including an entrant’s identity, age, place of residence, eligibility to enter and eligibility to claim the Prize) including by requesting entrants to produce within the requested time appropriate identification or other documentation. If an entry is not validated to the Promoter’s satisfaction the Promoter reserves the right to deem such entry invalid. The Promoter reserves the right in its sole discretion to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful, improper or inappropriate conduct. Errors and omissions may be accepted at the Promoter’s discretion.
  26. Entrants agree that they are fully responsible for any material they submit in relation to the Promotion, including but not limited to comments, recordings and images (Content). The Promoter will not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever.
  27. Entrants warrant and agree that:
    1. they will not submit any Content that is unlawful or fraudulent, or capable of causing harm to any person or entity, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, or otherwise unsuitable for publication;
    2. they will obtain prior consent from any owner(s) of any property in the Content, including intellectual property rights;
    3. the Content is an original work that does not infringe the rights of any third party; and
    4. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights.
    Without limiting any other of these Terms and Conditions, the entrant agrees to indemnify the Promoter for any breach of the above terms.
  28. Any costs associated with entering the Promotion are the entrant’s responsibility.
  29. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from an offender in respect to these Terms and Conditions are reserved. If the Promoter suffers any loss or damage or incurs any costs as a result of any breach of these Terms and Conditions or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for such loss, damage or costs.
  30. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion to the fullest extent permitted by law to disqualify any entrant or modify, suspend, terminate or cancel the Promotion, as appropriate and/or if necessary to provide alternative Prize(s) to the same value as the original Prize subject to any written directions made under applicable Australian State or Territory legislation.
  31. If a Participating Café ceases to exist at any time during the Promotion Period the draw for the separate entry pool relating to that Participating Café will still take place in accordance with these Terms and Conditions.
  32. Winners consent to the Promoter using, publishing or causing to be published: their name, suburb of residence, State/Territory of residence, likeness, image and/or voice in any media worldwide for an unlimited period without notification, remuneration or compensation for the purpose of promoting the Promotion (including any outcome) and promoting any products or services manufactured, distributed and/or supplied by the Promoter.
  33. Winners will participate in and co-operate with all reasonable promotional, marketing and editorial activities relating to the Promotion as requested by the Promoter or its agents and where requested by the Promoter sign any documents reasonably required by the Promoter to give effect to this condition.
  34. A winner can be disqualified at any time, even after being notified that they have won, if the Promoter in its sole discretion considers that a winner has not acted in accordance with these Terms and Conditions. The Promoter reserves the right to disqualify a winner or cease to provide the Prize to a winner if the winner engages in conduct or publishes material which the Promoter in its sole discretion considers to be offensive, inappropriate or defamatory or which breaches any law or infringes third party rights.
  35. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).
  36. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees (in which case that liability is limited to the greatest extent allowed by the law), the Promoter, its franchisees and its associated agencies and entities (including their respective directors, officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of or relating to:
    1. the Promotion;
    2. any technical difficulties or equipment malfunction;
    3. any theft, unauthorised access or third party interference;
    4. any entry or Prize claim that is late, lost, altered, damaged or misdirected;
    5. any variation in Prize value to that stated in these Terms and Conditions;
    6. the delay, postponement or cancellation of any activity;
    7. any tax liability incurred by a winner or entrant; or
    8. the Prize or any part of the Prize, including, providing, delivering, accepting, taking, participating in or using the Prize or any part of the Prize.
  37. As a condition of accepting the Prize or any part of it, a winner must, where requested, sign any legal documentation in the form required by the Promoter and/or Prize supplier in their absolute discretion, including but not limited to a legal release and indemnity form.
  38. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties. Entry into the Promotion and acceptance of the Prize or any part of it is conditional on providing this personal information. The Promoter will also use and handle personal information as set out in its privacy policy, which can be viewed at www.jamaicabluenz.muffinbreakdev.wpengine.com/privacy-policy/. In addition to any use that may be outlined in the Promoter’s privacy policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning an entrant or The privacy policy contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain about a privacy breach and how those complaints will be dealt with.
  39. By entering the Promotion and opting-in in the manner required entrants acknowledge that a further primary purpose for collection of the entrant’s personal information by the Promoter is to contact the entrant in the future with information about the Promoter, including special offers, market research or to provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share an entrant’s personal information with its Australian and overseas related companies, employees and agents who may contact the entrant for their legitimate commercial purposes, including special offers, market research or to provide the entrant with marketing materials in this way. By entering the Promotion and
    opting-in in the manner required, entrants acknowledge and agree that the Promoter and any applicable third paties may use their personal information in the manner set out in this condition.
  40. Apple Inc. is not a participant in or sponsor of this Promotion.
  41. In these Terms and Conditions:Immediate Family Members means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin;Eligible Product means:
    1. any size of the following products:
      • Espresso
      • Cappuccino
      • Iced Coffee
      • Latte
      • Iced Latte
      • Piccolo
      • Flat White
      • Macchiato
      • Long Black
      • Iced Long Black
      • Mocha
      • Iced Mocha
      • Affogato
      • Vienna
      • Dirty Chai
      • Ristretto; or
    2. any of the following products:
      • 250g retail coffee bag (either Signature Blend or Single Origin)
      • 250g retail decaf coffee (either Signature Blend or Single Origin)
      • 250g retail ground coffee (either Signature Blend or Single Origin)
      • 250g retail decaf ground coffee (either Signature Blend or Single Origin)
      • 100g retail Wallenford Estate ® Jamaica Blue Mountain® Coffee
      • Capsules – 10 pack coffee
      • 1kg Retail Coffee Beans (either Signature Blend or Single Origin)Jamaica Blue Café Store means a Jamaica Blue café store authorised to operate by the Promoter;
      Jamaica Blue Coffee means any one of the following Jamaica Blue standard menu hot coffee items:
      • Espresso
      • Cappuccino
      • Latte
      • Piccolo
      • Flat White
      • Macchiato
      • Long Black
      • Mocha
      Participating Café means a Jamaica Blue café store authorised to operate by the Promoter which trades at any time during the Promotion Period and chooses to participate in the Promotion.
  42. The Promotion is not endorsed, administered or provided by Dairy Farmers Pty Limited or BDD Milk Pty Ltd (or their Dairy Farmers, Pura and Masters brands). However, the Jamaica Blue Café Store supplying the Prize may, in its sole discretion, choose to use Dairy Farmers, Pura and/or Masters brand milk when supplying the Prize.
